By reserving a charter or using our Service, you consent to comply with these Terms. Should you not agree with any section of these terms, you must refrain from accessing the Service.

2. Service Overview

SoftHillTop offers exceptional yacht charter services, which include but are not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are contingent on availability and weather conditions. We hold the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To secure a charter, you are required to:

  • Be at least 18 years old
  • Submit valid and thorough details
  • Issue the necessary down payment as noted in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A confirmed booking is only established with the receipt of your payment and our formal acknowledgement. Service can be declined at our sole discretion.

3.3 Availability

All charters are subject to the availability of the vessel and favorable weather conditions. We strive to accommodate your desired dates and times to the best of our ability.

4. Payment Terms

4.1 Pricing

Prices are quoted in € and cover applicable taxes unless otherwise specified. Costs may vary and are subject to change without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the total charter cost is due at the time of reservation
  • Final Payment: Due 48 hours before the scheduled departure of the charter
  • Other charges (if any): Due at the end of the charter

4.3 Payment Methods

Payment can be made through major credit cards, bank transfers, and certified checks. Our secure and encrypted systems manage all payment processing.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours before departure: Full refund except for processing fees
  • Between 24 to 72 hours before departure: 50% refund
  • Under 24 hours before departure: No refund available

5.2 Weather Cancellations

If the captain determines that weather conditions are unsafe, we will propose to:

  • Reschedule the charter to a subsequent suitable date at no additional charge
  • Offer a full refund if rescheduling is not feasible

5.3 Mechanical Issues

If there are mechanical issues with the assigned boat, we’ll endeavour to provide an appropriate replacement. If another boat is not available, a full refund will be given.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions from the crew
  • Utilize safety gear as directed
  • Inform of any medical conditions that may influence their wellbeing
  • Stay within designated areas on the vessel

6.2 Prohibited Items

The following are not permitted on the vessel:

  • Glass containers
  • Illegal substances
  • Weapons or firearms
  • Excessive amounts of drinks
  • Pets (except with prior permission)

6.3 Conduct

Passengers are expected to behave in a respectful way. We maintain the right to end a charter prematurely without refund if a passenger’s conduct endangers safety or disrupts for other passengers.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the cost of your charter fee. We do not accept responsibility for:

  • Injuries incurred due to passenger carelessness
  • The loss or destruction of personal items
  • Indirect, consequential, or punitive damages
  • Delays from weather or situations out of our control

7.2 Insurance Coverage

We carry comprehensive marine insurance which insures our boats and operations. It is up to passengers to secure their travel and personal insurance.

7.3 Assumption of Risk

You acknowledge the intrinsic hazards of marine activities by taking part in our charters and you accept accountability for your own safety.

8. Modifications and Itinerary Changes

We hold the right to adapt itineraries, paths, or timetables due to weather considerations, safety reasons, or operational necessities. We will endeavour to offer comparable alternative experiences wherever possible.

9. Force Majeure

We cannot be held responsible for delays, cancellations, or alterations brought about by conditions outside our control, which can include but are not limited to:

  • Severe weather events
  • Natural disasters
  • Government regulations
  • Port closures
  • Mechanical breakdowns

10. Privacy and Data Protection

Your personal data will be processed in accordance with our Privacy Policy. Utilizing our services indicates your consent to our collection and use of your information as outlined in the Privacy Policy.

11. Intellectual Property

Our website content, including but not limited to text, graphics, logos, and images, is safeguarded by copyright and trademark legislation. Reproduction, distribution, or derivation of works is not permitted without our express consent.

12. Governing Law

These Terms are subject to the laws in force in Ireland. Disputes are to be settled in the courts of Dublin, Ireland.

13. Changes to Terms

We reserve the authority to amend these Terms at our discretion. Updates will be made public on our website with a notice of the revision date. Continued engagement with our services signifies agreement to the updated terms.
